THE FAMOUS MISQUOTED TASHBATZ MISUSED TO FORCE A GET!

This is the famous Tashbatz (V2:8) that is manipulated by crooked Dayanim as their support to force a Get.

They use the Hava Aminah and discussion in the Tashbatz, but they purposefully and conveniently leave out the final ruling of the Tashbatz in the end of this exact Responsa – where the TASHBATZ HIMSELF DOESN’T ALLOW FOR FORCE.

See underlined portion in attached screenshot. “And the correct way of doing it, is to “request” the Get” [and not through force].

The Tashbatz rules in 3 additional Tshuvos that you can’t force (V1:4, V2:180 & 256) – consistent with what he rules here.

Additionally, the Tashbatz’s son (Rashbash) and his grandson (Yochin Uboez) stated that they never saw forcing in their father’s house since it makes Mamzeirim.
